"Energy Dispute Resolution Mechanisms in Light of EU Law"

Abstract

The dissertation will deal with the impact of EU law on energy dispute resolution mechanisms. These include out-of-(state)court energy dispute resolution mechanisms and extend to both jurisdictional (arbitration, multilateral investment courts) and consensual (mediation) mechanisms. After analyzing the main aspects of EU energy policy, the dissertation will explore whether dispute resolution mechanisms in this area can be considered as regulatory tools lato sensu, ie whether such mechanisms have an impact on the regulation of the energy sector in the sense that they influence the behavior of participants in it, thereby enhancing or hindering the achievement of energy policy objectives. In this regard, the foundations and individual characteristics of these mechanisms will be sought and the scope of the regulatory intervention of EU law and case law on dispute resolution mechanisms will be critically analyzed.
